MIB encourages EU Commission to take action to mitigate unintended consequences of Vnuk

MIB along with a number of key industry organisations* issued a joint initial response to the EU Commission’s REFIT review of the Motor Insurance Directive on Monday 21 August.
While the REFIT covers a range of areas, MIB’s priority is to encourage the Commission to take action to mitigate the consequences of the Vnuk ruling in 2014.
Paul Ryman-Tubb, Chief Technical Officer at MIB said: “Ever since the ECJ ruled on the Vnuk case we’ve expressed serious concerns about it being implemented into UK law.
“It is absurd to put a compulsory regime in place that will be virtually unenforceable and risks undoing some of the really good progress made over the last decade, in reducing the level of uninsured driving in the UK.
“We are currently working on our response to the Commission’s full consultation due later this year where we will strongly urge the Commission to take action. We fully support the previous proposal from the Commission to amend the Directive to ensure that these changes do not lead to a series of unintended consequences, such as hindering enforcement, expanding the potential for fraud and the consequent increase in costs for motorists.”
